On Monday, the Sacramento-based social conservative legal group Pacific Justice Institute petitioned the 3rd District Court of Appeals to compel Gov. Arnold Schwarzenegger and Attorney General Jerry Brown to defend Proposition 8 in court. Brown and Schwarzenegger were named as a defendants in Perry v Schwarzenegger but refused to defend the ballot initiative.
Some good news. A notice posted to the court's website announced Presiding Justice Arthur G. Scotland has rejected the motion. The complete ruling should be available by the end of the day.
Meanwhile: Twenty-seven members of the California Assembly's Republican Caucus wrote Schwarzenegger and asked the governor to appeal the federal ruling that struck down Proposition 8 as unconstitutional.
