Sorry that this flew under the radar over the holiday weekend. Two of the three men convicted of brutally attacking a young gay Atlanta man and videotaping the assault were sentenced to ten months in prison for federal hate crime charges in late June. The case is the "first time federal prosecutors have brought hate crimes charges based on sexual orientation in Georgia," reports the Atlanta Journal Constitution and CBS Atlanta.
Christopher Cain, 19 (above) and Dorian Moragne, 20, both of Atlanta, pleaded guilty [June 25] in federal court to beating Brandon White because of his sexual orientation. Both Moragne and Cain were sentenced to 10 months in a federal prison. This is to run concurrent with the five years both are already serving.
Darael Demare Williams, Moragne, and Cain were all sentenced in state court in July 2012 to five years in prison and another five years on probation for each count, to be served concurrently. Charges for all three men included two counts of aggravated assault, robbery by force and participation in criminal street gang activity.
Cain and Williams pleaded guilty to federal hate crime charges in April.
The videotaped February 4 2012 attack against Brandon White went viral across the internet. Cain has been described as one of the "main aggressors" in the attack. The vicious beating of White began after Cain claimed White made a sexual advance toward him, according to court documents. White has denied the claim. Cain can be seen on the video "stomp[ing] Brandon White after he was punched and kicked" to the ground.
Other defendants were seen stomping and kicking Brandon White. Moragne was identified as the person who threw a tire on the victim.
Cain, Moragne and Williams were sentenced last July to five years in prison on aggravated assault, street gang activity and robbery convictions. Another defendant, 24-year-old Javaris Bradford, was indicted by a grand jury and apparently remains at large.
